EU Data Act: What Companies Need to Do Now

The EU Data Act is no longer something companies can treat as future legislation. Regulation (EU) 2023/2854 has applied since 12 September 2025 and affects how businesses access, use, share and control data.

For the logistics sector, this is particularly relevant where data is generated by connected vehicles, trailers, machinery, sensors, telematics systems and other IoT equipment. Users of connected products have new rights to access and share the data generated through their use.

Companies should therefore identify what connected-product data they generate, hold, receive or share, and review contracts with customers, suppliers and technology providers. Data-sharing provisions must comply with the new rules, including restrictions on unfair contractual terms.

Companies using cloud and data-processing services should also review their contracts and technical arrangements, as the Data Act introduces requirements intended to make switching between providers easier and reduce vendor lock-in.

For manufacturers and providers of connected products and related services, another important date is approaching: from 12 September 2026, newly marketed connected products must meet the Data Act’s requirements concerning access to product data.

The practical message is simple: map your data, understand who has rights to it, review your contracts and ensure that your systems can support the required access and sharing.
